Preliminary and final plat review for a 2-lot single-family subdivision

There was no petitioner at the meeting so the case will have to be continued. ***Adrian Reid moved to continue DP-17-13 to the next Plat Committee meeting. Eli Eccles seconded. The motion was approved by a unanimous voice vote.

DP-19-13 Kinser Group LLC

Preliminary and final plat review of a l2-lot commercial subdivision

James Roach presented the staff report. The property has 2 hotels on it connected by a breezeway. The hotels used to be 2 separate hotels but now they are connected, share a pool and parking. They would like to split the property in half so that each hotel is on its own property. They would like to keep the hotels connected by the breezeway so at a chokepoint there is a 0 setback. The Hearing Officer approved a variance less than a month ago concerning the 0 setback and some impervious surface coverage and parking issues. Everything is in place except for a sidewalk on Kinser. There are sidewalk and street trees along old SR 37. There is an issue with a water easement at the southwest corner of the property. It was an easement exclusive to the City of Bloomington recorded for a public water main. A few months after that easement was recorded a second easement was recorded that paralleled it for a gas main easement. The terms of that exclusive easement have not been upheld. He has been working with Michael Carter at CBU on potential ways to fix that situation. In Condition of Approval #5 outlines relocating the easement which is recommended by staff and CBU at this time.

Staff recommends approval of the preliminary and final plat request with the following conditions:

  1. Approved per terms and conditions of hearing officer variance # V-18-13.
  2. The propose property line through the breezeway must meet all building and fire code requirements.
  3. Five foot wide sidewalks are required along Kinser Pike and N. Old SR 37. Street trees are required along all street frontages, a maximum of 40 feet on center. Sidewalk on Gourley Pike must be repaired to the satisfaction of the City Engineering Department.
  4. Each lot must meet minimum ADA accessible parking requirements independently.
  5. The petitioner shall relocate the existing gas line out of the exclusive waterline easement as recorded in Instrument No. 2007014393 and as shown on the proposed plat. The petitioner shall then release the existing gas line easement as recorded in Instrument No. 2007019992, and record new easement based upon the new gas line installation. These actions must take place prior to plat signature.
  6. A right-of-way encroachment resolution is necessary for parking spaces that will now be located in the right-of-way. If a resolution is not approve, these spaces must be removed.
  7. A definition for the ingress-egress easement shall be included on page 2 of the final plat.
  8. Street tree species must be approved by the City's Urban Forester.

Sherman Bynum of Bynum Fanyo spoke for the petitioner. He outlined the issues with this property in the same way as did staff.

Roach said that the locations of these easements are important. If they are really deep or very close together encroachment is possible.

Lynne Darland asked if they were going to hold the plat until this is figured out. Roach said yes.

Adrian Reid asked if they needed an encroachment from BPW.

Roach said that with subdivision approval right-of-way is required to be dedicated. A 40-feet from center dedication is required on Kinser Pike. The front 1/3 of some of those parking spaces on Kinser are now part of the new right-of-way.

Reid asked if the sidewalk on Kinser is there already.

Roach said they have been working with Roy on it to determine the best location for it.

Reid said he recalled a big pole in the way of the sidewalk. He would have thought by the size of the site and the amount of grading work going on they could have done some stormwater quality. The previous work on this site was in 2007 or close to it.

Roach said he didn't recollect it. He remembered a new pool and some site clean up.

Reid asked if there was a wall on Gourley.

Bynum said there is a retaining wall in there.

Reid said he would like to add "existing sign" to Condition 6.

There was no public comment.

***Adrian Reid moved approval of DP-19-13 with the 8 conditions outlined by staff with an amended 6th Condition to add "existing sign that will be in the right-of-way and dedicated correctly." Eli Eccles seconded the motion. The motion was approved by roll call vote 3:0.
