Subject: Formal Complaint and Damage Notification – Fallen Tree Incident at the corner of 700 Ashlynn Park Dr. & 300 W. 11th St. Bloomington, IN near Upland Brewery. Dear City of Bloomington Officials, We (Katherine & Renas Van Lue) are writing to formally report an incident involving a hazardous tree that resulted in significant damage to our parked vehicle. The tree in question, located near the sidewalk and parking meter of 700 Ashlynn Park Dr. & 300 W. 11th St. Bloomington, IN ( near Upland Brewery )dropped a large bough on our car on the night of May 21,2025 at approximately 10:40pm. This location is marked by a clearly deteriorating and partially dead tree, which appears to have been neglected for a significant period. As seen in the attached daytime Google Maps Street View (screenshot dated 2025) and our personal photographs taken at the time of the incident as well as the next day during daylight hours, the tree shows clear signs of rot and structural instability. It is evident that this tree posed a danger to public safety and property, especially in an area with active parking meters and pedestrian traffic. The incident has resulted in physical damage to our vehicle, which was legally parked by the curb at a paid meter. A section of the tree broke off and landed directly on the front of our car, causing not only structural damage but also significant inconvenience and cost. Two witnesses were at the scene. This situation could have easily led to personal injury had someone been present near the vehicle at the time. Given the foreseeable and preventable nature of this hazard, we respectfully urge the City of Bloomington to: 1. Investigate the incident and confirm the ownership and maintenance responsibility of the tree in question. 2. Take immediate action to remove or professionally inspect the remaining portion of the tree to prevent further harm. 3. Reimburse or assist with damage-related expenses caused by the City’s negligence in maintaining public safety. safety. We would like to note that after the incident, we called police to report what had happened and police just said to contact our insurance instead. No police report was made. Our insurance company has been notified and a claim has been filed. We have not been given any estimates of the damage. We are awaiting for an adjuster to come and view the damage. Please let me know the next steps in initiating a formal claim for property damage and what further documentation may be required. This heavily used biker/walker commuter path from Morton onto the b-line gets blocked with snow everytime it's plowed, but it would be easy for the plow drivers to leave a bike/walk pathway so we don't have to carry our bikes over the snow several times a day.

To the City of Bloomington, There is a ~500 foot stretch of unmaintained city property, along the north side of the 300 thru 400 block of S. Morton St and boundary of the B-Line trail. This area has heavy overgrowth, attracting trash and debris and becoming a dumping location. A recent dumping of two discarded bicycle frames has prompted calls to police for possible theft related activity. The overgrowth is obscuring street signage, that could be a security hazard to drivers thinking that northbound from Smith on to Morton is unrestricted - which it is not. This area of overgrowth is encroaching on both S. Morton St, and the B-Line trail, and recently we've observed numerous late night gatherings of homeless/vagrants (on the B-Line) because it appears that this overgrowth provides visual shelter and seclusion from being observed along the B-Line from S. Morton St. If it hasn't already been used in this way, this area is prime for unsanitary use for urination or defecation in this stretch between S. Morton St and the B-Line trail due to the seclusion this overgrowth provides. To the north and south of this heavy overgrowth, the similar stretch of B-Line boundary is well-groomed, and offers the public the desired visual beauty of the trail, yet this ~500 foot section provides exactly the opposite as described in this cleanup request. We are asking that the City of Bloomington put this stretch of unmaintained city property between the 300 thru 400 foot blocks of S. Morton and the B-Line Trail, on a regular, ongoing, and permanent maintenance plan. Owners/Residents of 348 S. Morton St.

City of Bloomington (Historic Preservation Commission?) My wife and I recently purchased and moved in to 348 S Morton St, which is on the Indiana Historical Registry. Earlier this month, using uReport Case 181400, we requested Parks & Rec to help with some heavy brush between S Morton St and the B-Line (they were very responsive -- nice job Paula and Team! :-)). Reviewing the work after clearing was done, walking along the B-Line trail, just below 348 S Morton St, I noticed some block/stone work that might be quite old (pic attached). It appears the block/stone work is there to shore up the embankment for a considerable stretch of S. Morton St. Now that it's visible, it appears that this block/stone work is in a state of disrepair :-( A couple of thoughts: • Is it possible this could be looked at to see if this block/stone work has any historical significance • There could be some concern that this block/stone work may not have the original integrity it was intended to have regarding shoring up the embankment along a stretch of 348 S. Morton St.
