Smoking Violation

Spring has started and the outdoor smoke coming from the Barbecue is in full force at the Short Stop food-mart on North Smith Road. My wife and I had three meetings with the City Council about this issue in 2015. And 2 recorded meetings with the council as a whole and a second meeting a few weeks later. The smoke issue was to be addressed for this location. But Chris Smith sold the store without implementing the standards the City Council had requested he perform. He was supposed to install and indoor smoker by December of (2015) that never happened. And he then sold the business in spring of 2016. As an example of how bad this smoke is. I hung wet laundry outside yesterday (Wednesday 4-25-18). Hoping for that nice fresh air smell when it was dry. Our clothing smelled like we had been next to a campfire. So I had to rewash all of the clothing. This has become a HUMAN HEALTH hazard and it has not been taken seriously. The city did nothing after our meetings to address SMOKE issues from cooking outdoors. I really hate to call the Fire department each time I smell smoke. As the cost to the city will be ridiculous for putting out (3) outdoor smokers. But that is what I am going to start doing. As we cannot breath. She had a lung removed and everyone is turning a blind eye towards this fact. Let me know what the city can do. Our district representative Allison Chopra was at the meetings as she was running for office and won the election. But I was told she had slept since the meetings and did not remember the restrictions placed on the smoke issue. Blocked Street

The North/South alley between 810 W. 7th and 804 W. 7th is being encroached upon by gardens, woodpiles, trees/vegetation and possibly the fence and cinder block garage owned by 810 W 7th St. As a result, the alley traffic is being diverted outside of the alley right of way and onto the private property located at 804 W. 7th. This appears to have been going on for a number of years. As the new owner of 804 W. 7th St., it is my full intention to re-claim the property/property line currently being encroached upon and proceed with renovations. I request that the Street Dept contact the owner of 810 W. 7th and order the encroachments be removed. With the assistance of a surveyor, I have located the NW and SW corner pins delineating the right of way and pounded new T posts just outside of the right of way in those spots and plan to post the entire property line once the encroachments are removed. Were I to reclaim the property line today, the alley would become impassible due to said encroachments. I request your assistance in remedying this situation in a civil and legal manner, as requests to the homeowner of 810 W.7th have fallen upon deaf ears. I request that you keep me in the loop regarding this issue. I would be happy to meet with a representative of the street dept, with survey in hand, to assist in clarifying and remedying this issue, as renovations of 804 W. 7th will begin in a few weeks. We were charged over $300 under sanitation for "Large Item Pick up", however, were not responsible for any items that were allegedly picked up. I have tried to get in contact with the sanitation department for the past month with no avail. I would like to get this issue resolved so I am not responsible for the charges or the late fees that could potentially accrue. Hello-There are regularly cars blocking the bike lane on Washington between 4th and 3rd St's a bit after 6pm.I wonder if there's a way for the city to make it clear to ride share drivers and customers of DaVinci that this is illegal and that they cannot block the bike lane. When there are 3-4 cars parked in the bike lane here, it really is no longer a bike lane and instead is a pick up/drop off zone. "Sending people to patrol the area" is definitely not working.  Thanks!

Cover to my main H2O shutoff at the street apparently was buried by dirt when they installed the fiber box on the SW corner of my lot. Today I was Unable to locate cover without metal detector to keep the vegetation clear of it. I have a plumbing project coming up that I’ll need to shut off the water at the street this summer. Sunday afternoons, even in the downtown area, should be a chance the peaceful enjoyment the premises of one's own abode. Today, however, the noise from the sidewalk musicians who are somehow sponsored by the record store on the east side of Walnut just south of Sixth Street, makes any peaceful enjoyment impossible. I have my windows shut, even though I should be able to have them open on a day as warm as this, and even though the windows are shut, the noise is quite intrusive. Does Bloomington not have a prohibition against this kind of use of the public right of way? Don't you need a permit, or can any business just say: Hey come play the drums and electric guitar out in front of my shop? More maybe they do have a permit. If they do, they should post it so everyone can see that it is allowed. I understand a certain amount of weird noises are part and parcel of downtown living. But this seems like an abuse of the downtown public sphere. Thanks for whatever you are able to do to help make downtown Bloomington actually livable.

Inaccessible Parking

I am 62 years old, and this time last year I was just getting back to work after 3 1/2 months rest healing from a broken ankle. When I moved in to 1200 W 12th St, I noticed the sign (photo #1). I even asked Bloomington Housing Authority about it. They said it would be okay to park in front of my apartment. I have been parking in front of my apartment since March 2024. No tickets, no problems. It made it very easy to get to my apartment - load or unload my car - and I could keep an eye on it while in my apartment. Today I get home from work (I work full time at IU as a custodian. Yes - I work FULL TIME and still need Section 8 to get a place to live) to see fresh paint denying me my usual parking spot. I had an ADA tag for a while, but it was temporary. It expired. The problem is: I can’t see my car now unless I get up and look through the one window that lets me see my car. If I have to park farther away, I won’t be able to see it at all, and I will have to walk farther and across the street to access my car. I am old, diabetic, autistic and cannot walk a far as I could before the broken ankle. After work, it is very common for my right ankle to be aching on top of the Diabetic Neuropthy I have in both feet in addition to my jangled nerves from interacting with people and handling emergencies. This neighborhood can get a bit sketchy sometimes - it helped my normally high anxiety level to be able to see my car. My anxiety is already high from people walking so close to my apartment and cutting through my yard - can’t do anything about that so I live with that anxiety. I don’t want to break the law, but this is so unfair! I already pay $828 a month for this tiny apartment - that is ONE WHOLE PAYCHECK. My rent is figured as 30% of my GROSS income. I pay quite a bit for my taxes and Insurance, and I have quite a few medical issues so I have to scramble sometimes to get bills paid and pay for all the drugs I have to take. I live paycheck to paycheck. I have to work so I have health Insurance. Even though I am 62, I can’t get Social Security if I want to live here because it would price me out of Section 8 and I would have to move (AGAIN - I just moved in here a year and a half ago). I can’t work less because i need Insurance from work until I reach 65 and can get Medicare (if it still exists by then). If I have to park further away, then my ankle will be that much more achy when I get home. I’m going to see if maybe I can qualify for a permanent ADA Tag, but even then the 4 HOUR LIMIT would kick me in the butt. That doesn’t even take into account bad weather days or having to walk farther with loads. Where I am currently parked in photo #7 would be a better ADA space. Usually no one parks there, and it is closer to the Boys and Girls Club. Please help me.

Mike Frey - 317-727-3371 Mike is the owner of Bub's on the corner of 9th Street and N. Morton. The last parking spot on 9th street before you hit Morton has been turned in to a handicap space. According to Mike this space is on a hefty incline that was once riddles with pot holes. He stated that it is smooth, but that it is not an accessible space by any means being on a hill. He would like someone to reach out to him. Thank you!
