The USB denied Mr Kittridge's appeal and he accepted it.
Phone Call: Mr. Kittridge left a voice message on 9/2/14. He is the treasurer of the Peppergrass Homeowners Assoc. and wants me to meet with him to discuss a problem w/storm drainage in Peppergrass that relates to the city employees believing that the storm drainage facilities in Peppergrass are privately-owned. He says that is incorrect and that he has documentation showing they were taken over by the city back in the 80's & 90's as part of the annexations of that area into the city. He needs someone who can help resolve that issue so they can get some stormwater drainage system problems repaired.

Patrick Murphy, Tom Swafford & Jane Fleig met with Mr Kittridge on 12/10/14. He will be presenting his appeal to the USB on 12/15.
Patrick left a message for Mr Kittredge to call back.
Patrick told me yesterday that he had spoken to Mr Kittridge and planned on scheduling a meeting with him when Tom Swafford is available.
Patrick is going to schedule a meeting with Mr Kittridge.
I called Mr Kittridge this afternoon to let him know that our Legal Department agrees that our storm maintenance requirements are within public right of way only, as they are in other neighborhoods. He said some of the problems they are seeing is erosion/settlement around beehive inlets that are on the back side of the sidewalks and he thinks those should be ours to maintain as well. He said he will plan on going to the Utility Service Board to get action because that's what he had to do a couple years ago with the sanitary sewer maintenance. I told him I would talk with Patrick Murphy to let him know he wants to go to a board meeting. I spoke with Patrick and he said he would call Mr Kittridge in the next few days to discuss it with him.
Mr Kittridge called again to ask two questions: 1) He noticed flags and markings by the 6" storm sewer on Pepperridge Dr and wanted to know what was going on. I told him I would have to check with Tony E but it may be possible he is trying to reroute the storm flow to the south and eliminate the 6" pipe since that was what he told me he intended to do when he could get to it. 2) He asked whether our attorney has been contacted about the annexation issue he presented earlier this month. I told him I forwarded everything to our attorney but have not heard anything back. I will check with Greg to see whether he has made a determination.
I returned his call on 9/3/14 and then met with him the same day. I explained we maintain the storm sewer infrastructure within the public right of way but not beyond. He showed me the annexation language that he believes obligates the city to maintain ALL of the storm sewer infrastructure. I told him our attorney would have to look at the information and it may be a couple weeks before I can get back with him.
