Line of Sight: Complaint

Phone Call: Mr. Carpenter called to complain about a line of sight issue at the intersection of Sunny Slopes Dr. and Ridgeview Dr. due to excessive growth at 218 E Sunny Slopes Dr. He reported several "near accidents" on account of the growth. See attachments.

I contacted the property owner via mail with a notice of violation letter. I also contacted them via phone call. I also met with them at their property in order to give better direction about what trimming would help. After a couple of attempts the obstruction was abated. They promptly took care of the line of sight obstruction. I also contacted the constituent via email and phone call to make sure they were aware of progress and abatement.

Reevaluated this intersection today. The property owner trimmed the Aster down. Line of sight is now adequate for motorists traveling north on Ridgeview looking east for motorists traveling west on Sunny slopes.

I reevaluated this intersection yesterday 9/22 and the Aster clumps are blocking line of sight. I contacted the property owner via phone call today to let her know they need to either be trimmed or moved. The owner stated they have a busy weekend but will attempt to have it taken care of by Monday. They will call me with an update on Monday on their progress. I brought up the trucks parked on the street at our traffic concerns meeting and the engineers agreed that we should wait for any decision about the parking until the Aster plants are taken care of.

Spoke with Mr. Carpenter today about his report. I gave him an update about the property owners progress and my reevaluation today. I let him know there is still more trimming to happen. He let me know he was thankful for how helpful and kind myself and Matthew Wolfe have been. I gave him Doris Sims' phone number because he wants to make an official complaint about the way HAND treated him and his girlfriend when they called about this issue.

Stopped by Friday 9/16 and got to speak with property owner. They had someone working at that time to trim the area for better line of sight. I explained the area that needed most attention so they didn't have to take out too many flowers, including two Aster clumps that i thought would be sparse enough in the lower half of the plants to have appropriate sight through them. I inspected the intersection again yesterday (9/20). Unfortunately I was wrong about the Aster and will need to recontact the property owner and ask they be moved or trimmed very low. I noticed a white truck parked on the North side of Sunny Slopes that seemed to be blocking line of sight as well. I will ask Neil about that concern. I will call Mr. carpenter to give him an update

Message from Mr. Carpenter: "I cannot find anything on this particular case. Are there any updates. This is a very serious safety concern in my professional (and personal) opinion. I will find think of this as a huge disservice to our citizens if nothing is done about this. I will also see it as grossly negligent and irresponsible concerning the safety of any pedestrians, cyclists or motorists that travel this area. It would nearly infuriate me if this property is allowed to interfere with the safety of possibly hundreds of people because they simply have "nature" signs up on their property. HAND has annoyed me with warnings and tickets in the past for having reusable construction materials on my property waiting for allocation at another site, or for having 5" grass (when the ordinance is 8") after its rained nearly every day and not had time to dry out for 10 days. It's bad enough I have advised HAND of a no trespassing order on my property. Yet this actual concern falls on deaf ears up there. I truly thank you for your time and efforts on this. None of my personal feelings are directed towards you. You've been very pleasant and helpful throughout. Absolutely nothing was done, and it was made clear they didn't care, when other places were contacted. The issue now is this: (Hypothetically if nothing is done, or in the meantime before anything is done) This now becomes a liability issue for the city. Much like after reporting a pothole, this is a very legitimate safety concern, and since the city has been made aware of it, if someone gets hurt due to this issue it seems it would be easy to show negligence in the handling of this issue, and sue the city, costing taxpayers and insurance a lot of money. This is a complaint that has already been investigated and is in process. See the information below about this intersection update. I inspected this intersection today 9/7/2016. The tall weeds/flowers on the Southeast corner of the intersection creates a line of sight obstruction. Drivers traveling North on Ridgeview do not have adequate visibility of westbound traffic on Sunny Slopes when attempting to turn West onto Sunny Slopes I couldn't find a phone number so I sent a Notice of Violation letter to the property owner. Will recheck location in 10days.
