Due to outside area being communal property according to HOA rules there is no violation of Title 7 at this time.
Phone Call: The woman at this address has a dog that has been running loose and leaving excrement on the neighbors' properties. Several complaints have been filed since the first incident on Thanksgiving, but the woman still refuses to put her dog on a leash. Woodlands Winding Brook has a By Law that requires dogs to be on leashes. According to the constituent who reported this, several other incidents related to this dog and dog-owner have already occurred. I would suggest getting into contact with them for the entire story. Constituent would like to be notified when this matter has been resolved, and would like it to be resolved as soon as possible.

Contacted Vicki via phone. Informed her that due to the way City Code is written the woman in question is doing nothing wrong. Encouraged her to take the information back to the condo association to deal with the dog off-leash and defecting on shared property.

She called this morning to say that the dog issue had quieted down but has reappeared, and the neighbor with the dog isn't abiding by City ordinance, which should trump HOA rules. City Legal Department investigated issue. Due to the area in question being common property, the animals are properly restrained according to City Code, Title 7. Animal Control Officers are unable to enforce association rules. Legal Department contacted Vicki Linder to discuss.

Following is an excerpt from the By-Laws: 14. ...No animals, except dogs, cats and other common domestic house pets may be kept on the premises, and no pets may be quartered out of doors. No pets may be put outside unattended. When exercising pets in the Common Area, Unit Owners shall be responsible for clean up or be fined $50 per offense. Residents may use the wooded area to exercise animals. Any animal deemed a nuisance by the Board of Directors shall be removed upon three (3) days written notice. NOTE: City ordinances require that dogs be confined on a leash at all times while outside the Unit Owner’s unit or be under the owner’s control.
