closed: Can't Fix #170500

Web Form: 1508 W. 11th is going to be sold in a Sheriff Sale on Oct 18th. Contractors for the lawyer/bank who repossessed the property due to the death of the owner have already cleaned out the house and have been keeping the property mowed. However, because the house is vacant, the neighbors to the east (1506), have been stacking/throwing trash, debris, etc. into the house. It is just packed with it. This is absolutely unfair to any potential buyer of 1508 as they will have to pay for the removal of this garbage once they purchase the property. 1506 needs to dispose of their own damn trash.

This is not a matter that the City could legally resolve. The issue was solely a private matter concerning private property. The only thing that could be done is to have the Bloomington Police Department look into the matter had the owner of the real estate made a report to the police for trespass. This did not occur. The ureport was opened by anonymous so there was no contact with constituents here.

The only ordinance that the City could possible apply to this issue would be Title 16, but the property is not rented and therefore not subject to rental. Title 6 does not apply because the trash complained of is apparently inside the home. Any trespass would be a complaint to police made by the owner of the property, which has not happened. There is nothing legally that the City can do in this matter.

Chris, I don't believe HAND can do much as we'd need to observe or have trash external the house for any sort of trash or dumping fine. With it being in the house coming from a neighbor allegedly, is this something Legal has ideas on per Adam? It feels more like a potential criminal issue to me with police involvement. Thanks.

HAND neighborhood compliance officers will inspect the property and determine if the cited trash at this property is in violation of Bloomington Municipal Code 6.06.070 (a). In the event of a violation, the neighborhood compliance officer will issue a Notice of Violation to the property owners via first class mail and by placing a copy of the violation on the property. After the Notice of Violation is issued, the property owner and/or tenant has seven (7) days to bring the property into compliance. If the property is not brought into compliance within the initial seven (7) days, the inspector may go to daily tickets. Thank you, HAND staff
