Staff is closing this ticket because we do not have information at this time that confirms a violation. Please contact Planning and Transportation Department's enforcement team at (812) 349-3528 or (812) 349-3592 if you or anyone else can provide more information. First, the light fixtures appear not to comply with light shielding in the City's Unified Development Ordinance [UDO section 20.04.090(c)(5)(A)]; however, we can only lawfully enforce against this non-compliance if it first became non-compliant after the adoption date of this provision of the UDO (in this case, 2007). We do not have evidence or documentation showing that the non-compliant lighting was installed after 2007. Second, the light fixtures may be causing light trespass in violation of UDO section 20.04.090(c)(4); however, because the garage door is pointing to the west and not to the north toward the public right-of-way, there is not light trespass into the public right-of-way where staff can measure without an invitation to enter private property. We do not have evidence of light trespass. If anyone can provide documentation that the non-compliant light fixtures are newer than 2007, or if the neighbor to the west can give us permission to enter their private property to take measurements of light trespass, please contact the Planning and Transportation Department's enforcement team at (812) 349-3528 or (812) 349-3592.

Staff will investigate. Due to scheduling limitations, we anticipate that it will be late next week / beginning of April when we are able to investigate.
