Planning staff investigated the site and found that the lighting element is exposed as the fixture is aimed slightly upward. Staff are in contact with the property to get the light (installed sometime post 2014) to be angled downward so it meets the shielding/lighting element standard required.

It could possibly be something that Title 20 can address. The image submitted doesn't clearly show if the light fixture is shielded fully or not. Another factor for if we can address this would be how long this fixture has been in place or not (if it predates the shielding requirement and has not been changed, then we do not have a mechanism to compel the site to change the fixture). Staff will investigate it as soon as available.

There are light trespass standards in the UDO, which may apply in this situation. Forwarding this case to the zoning compliance team for investigation of possible violation of light trespass standards.

Gabriel,
The light trespass issue involves a private street light on private property. Does this fall under the UDO?
Thanks,
Christina
