closed: Can't Fix #202021

Other: I'm inquiring regarding a fence my neighbor is erecting that is well over 6 feet at every post. If I was to dispute or request someone come out and inspect the fence, how would I go about doing that? Please see the attached photos. Thank you so much for your help! Best wishes, Keith

Planning staff went by the reported property and observed only a portion of a newly installed fence that appeared to be compliant behind the front building wall. As previously discussed with other staff members, if the dispute is regarding the location of the fence on private property that would be a civil matter/dispute.

David Brantez and I (Gabriel Holbrow) both spoke with the complainant on the phone. Based on what the complainant reported, it sounds like there is probably no UDO violation, but this could be evaluated with a site visit. If the complainant's information is correct, the fence is being installed on his property (without his permission) and within a platted utility easement. I advised the complainant that this is likely a civil matter between two neighbors that the City would not be a party to.

Hi Joy, reassigning this for Planning investigation. It appears this is an interior lot and as per the Fences and Walls standards in UDO section 20.04.080(n)(3)(A), i. Behind the front building wall of the primary structure, fences and walls shall not exceed a combined height of eight feet, except as provided in Subsection (1)(G) above. ii. Forward of the front building wall of the primary structure, fences and walls shall not exceed four feet in height. We can see what we can view from the right-of-way, but without scale, we cannot tell the exact height of the fence or if it exceeds 8 feet from the ground across each panel. Generally, fencing is permitted up to the property line and City Planning does not require a permit for construction of a fence.
