Temporary Signage w/o permit:

Other: There are many "for rent" signs that sit in yards sometimes for many months. Are they legal? How long are they allowed to sit there? Also, at this particular address they have an additional sign that is affixed to the porch. How many signs do you let them have? And are they allowed to have permanent ones up even when the property is not actually for rent? And can they be attached to the building/deck, or do they have to be free-standing?

Planning staff observed permanent signage displayed without a permit on the railings of the porch. We will draft and issue a Notice of Violation letter to the property/signage owner for permanent signage displayed without a permit on the prohibited location of railings, establishing compliance deadlines for its removal.

In accordance with the City's Unified Development Ordinance (UDO) Section 20.04.100(c)(2)(C) [Development Standards & Incentives; Signs; Signs Not Requiring a Permit; Temporary Signs], every property is allowed to display 3 small temporary signs without requiring a permit: 2 signs of up to 5 square feet in area and 1 sign of up to 8 square feet in area. There are no set time limits for how long those three small temporary signs are allowed to be displayed at a property, although by definition a temporary sign is intended to be displayed for a limited period of time. By nature of their temporary design, materials, and display method, there should be inherent limits on how long a temporary sign can be displayed at a property. Signage has been litigated at a federal level to the point that no municipality can regulate signage based on content, so it does not matter what the signs are for whether that be for a business, event, or cause, etc. What matters is that the signs are compliant with size, location, material, and display method standards. Regarding permanent signage, if larger than 1.5 square feet, all permanent signs would require a permit. Staff will investigate as we have time.
