Other: We have had an issue with the overgrowth at 708 W. 11th Street encroaching upon our property at 702 W. 11'th and 702 1/2 N. Fairview St. for years and have spoken with HAND inspector before about the problem which consists of us at 702 W. 11th St. to constantly be cutting tree branches that over hang, and fall onto our property and constantly clean up all the leaves that fall and the vines which grow at least one foot per day in the summer. We have asked for cooperation from the people that live there as tenants, however we feel it is the owners responsibility to clean up the property. We have a fence between the properties and since we are registered with HAND and have had to make many improvements to our own property in order to comply to the rules and regulations we feel it would be the least 708 W. 11'th St. could do is to keep up with their lot which stretches back at least 1/8th of a city block. We have had to hire tree cutters in the past at least 3 different times to cut back the limbs of the largest trees as they were growing over the grooves of our 2 buildings and constantly dropping debris. We have clear out what we could this early Spring however after painting our fence in April the grown has encroached to the point that we have the necessity to clip back the invasive vines on a daily basis. Hand can issue a notice of violation for excessive growth of grass and weeds to a property. Any dispute over encroachment of overgrowth or who cleans up the limbs or other items hanging over a neighboring property is a civil issue between property owners and HAND does not get involved in any civil matters.

We value your input and hope that we will be able to address your questions and concerns. HAND neighborhood compliance officers will inspect the property and determine if the weeds, grass or plants are in violation of the Bloomington Municipal Code 6.06.070 (a). In the event of a violation, the neighborhood compliance officer will issue a Notice of Violation (NOV) to the property owners via first class mail and by placing a copy of the notice of violation on the property. The original Notice of Violation may be a warning or may include fines with a graduated scale from $50.00 - $150.00, and will be issued in accordance with Bloomington Municipal Code 6.06.070 (a). If the property is a rental property and it is the tenants' responsibility to maintain the lawn, the landlord must provide a copy of the signed lease to HAND during the initial seven days following the issuance of the NOV, otherwise the Landlord will remain responsible for paying the fine. After the Notice of Violation is issued, the property owner and/or tenant has seven (7) days to bring the property into compliance. If the property is not brought into compliance within the initial seven (7) days, the inspector may go to daily tickets. Please be mindful of this process while we work with your neighbors to resolve this issue. Thank you, HAND staff
