Unsafe Buildings: Comment

Walk In: A gentleman stopped by our office this morning to alert us to an unsafe swing set that was installed in the yard of 825 S. Eastside Dr. He said that the swing is installed in a way that it would go into the road if someone was on it. He is nervous that a kid is going to swing on it unsupervised and go into the road. He would like to remain anonymous.

Drove by the swing (picture attached). Neither the tree nor the swing are in public right-of-way. The Engineering Division can only enforce upon items which are illegally in the right-of-way. I understand the concerns of the constituent who reported this, but the swing does not appear to be in violation of any code.

If the swing set is not currently in the public right-of-way, the engineering division cannot take any action. The potential of a swing set to end up in the right-of-way cannot be enforced upon. This sounds like a setback issue.

This does not appear to be recreational equipment as defined by Title 20 and would not subject to setback standards. It may be best to address as a right-of-way issue.
