City of Bloomington, Indiana

closed: Resolved #185026

Line of Sight:

Other: My son, Jeff Shew, lives at this address. He has contacted the city about having the side of the road mowed. His driveway is on a hill and there is no visibility coming out of the driveway. Saturday when I left this address, I had to inch my way out into the roadway to see if anyone is coming. Luckily for me, the car coming, which I could not see, slammed on their brakes and narrowly missed hitting me. Will it take an accident or death to get the city to trim this area????!!!! Please address the issue immediately and get back to me.

Adam, I visited the area in question and can confirm that the limiting factor in the line of sight is the vegetation in the street tree lawn area.

Ms. Shew, Per City code, that is referenced below, it would be the property owner who would be required to maintain this area. From the looks of my research that language has been in City code since at least the 1990's, with an amended ordinance in 2008. Mike Stewart, can you or Kyle visit the location and determine if my account of the situation is correct? 12.24.030 - Tree lawn area maintenance. (1)The city shall have all the right and authority granted to municipalities under law to require the owners of parcels of land adjacent to a public street to maintain and improve the street tree lawn area. Such maintenance and improvement shall include, but is not limited to, leaf raking, turf grass mowing, brush collection, and landscape bed maintenance.(2)The surface of tree lawn areas shall be as level as practicable, and the grade thereof shall be the top lines of the sidewalk and curb. No person shall pave, gravel, remove or otherwise convert existing grassed tree lawn areas. (Ord. 08-06 § 2 (part), 2008).
