TO AMEND TITLE 2 OF THE BLOOMINGTON MUNICIPAL CODE ENTITLED "ADMINISTRATION AND PERSONNEL" AND TITLE 20 OF THE BLOOMINGTON MUNICIPAL CODE ENTITLED "UNIFIED DEVELOPMENT ORDINANCE" - Re: Various Changes to Make the Local Code Consistent with Other Provisions of the Code, State, and Federal Law, and Best Practice

This ordinance corrects inconsistencies in the current Unified Development Ordinance with other portions of the municipal code, the State code and the U.S. Code. It corrects mistakes in Title 2 referencing the Indiana Code and Title 20 of the Bloomington Municipal Code. With the passage of new zoning regulations at the State level, an aggrieved party’s right to an appeal was reduced from 14 days to 5 days, as such the local municipal code must also be changed. The State’s new zoning regulations also increased the vesting rights of property owners from 7 years to 10 years. This ordinance changes the duration periods for approvals throughout Title 20 so that all duration periods are for three years. It changes the procedure allows for a plat vacation even if not all owners of land in the Final Plat are in agreement regarding the vacation to be in agreement with Indiana laws. It makes changes to local code that prohibits local units of government from denying requests for modifications of existing wireless towers or base stations if the modifications do not substantially change the physical dimensions of the tower base stations to comply
