Not sure if there is anything we can do in the case of noise that is occuring before 10pm. However, wanted to pass this along just in case you receive complaints that this noise is continuing after 10 pm.

Planning staff have commented regarding the updates we have per leadership on this reported property, but as Planning does not enforce the sound ordinance (that is BPD) and does not regulate the ROW I am passing this on. Can you see if your team can take a look in regard to the updated report of the sidewalk being blocked at this address? Thank you!

Thank you for reaching out with your concern regarding the previously reported property on S Palmer AVE. This matter was previously escalated to our Assistant Director and our Director. A recent report was also sent to Parking Services, so they can monitor the roadway as Planning has no jurisdiction over the right-of-way. Staff will continue to monitor the area, but as previously indicated Planning staff are not able to escalate enforcement actions unless there is evidence of a business ongoing. Individuals are allowed per code to have up to 3 vehicles be repaired lawfully at their property for up to 30 days. Previous inquiries with the property owner resulted in them attesting that all vehicles were plated and owned by the property owner. If you have additional evidence you would like to submit or would like to speak to leadership further regarding this property, we are happy to discuss! The matter at the reported property was discussed again on 04/09/2026 with City Legal and it was determined that the City would not have cause to issue a Notice of Violation letter regarding Title 20. Staff did learn that the State of Indiana requires any person who sells 11 or more motor vehicles during the course of a year to obtain a motor vehicle dealer's license. Such license would require the sign-off of the local zoning authority (City Planning in this case) to be valid. Planning staff have not received a request to authorize a dealer's license for this address, so that indicates that the resident is either selling less than 11 motor vehicles per year, or they're avoiding the notice of the Secretary of State's office somehow. Complaints regarding the sale of such vehicles can be made to the Indiana Secretary of State's office at 317-232-6531 or through their online submission form https://in.accessgov.com/sos/Forms/Page/sos/contact-us/.
