In regards to resolved uReport# 181500: Reply from City: Up until recently, we've been relying on the scooter companies to enforce their users behaviors with illegally parking of the scooters. We have two positions that we are currently hiring for that are funded with fees from the scooter companies that will focus on moving into a system where fines will be issued for improper parking. My reply with two (2) questions: I do not understand Adam Wason's reply in light of what was stated by City Attorney, Mike Rourker, in 2019 (please see below for quote). Additionally, I worked from March 2019 until October 2021 as the main point-of-contact (POC) working with the entities licensed by the City for providing the service and product of motorized scooters, and neither was I informed of any efforts to ticket the companies nor the users of the scooters. Can someone please explain to me what the Standard Operating Procedure (SOP) for holding the licensed entities accountable for the stipulations in the ordinance governing use and management of the scooters was prior to the recent creation and hiring of a new staff position? Also, why were no violations issued and no fines collected in over three years? Thank you for your time. "At its July 31, 2019 meeting, city attorney Mike Rouker told the city council that scooter companies would be fined if their users violated the parking restrictions. Rouker put it this way: “So just to be clear, at the same time, that Bird or Lime or another scooter company may be taking those additional steps against their own users, the city, if this is an issue, will be fining them every single time we see a parking issue.” Rouker continued, “I suppose if the company wants to move very slowly and pay lots and lots of fines to the city, until we’re fed up enough that we either revoke their license or geo-fence an area, that’s a business decision. But I don’t know if it’s a sound business decision.” For an improperly parked scooter, the fine called for in the city’s ordinance runs $30. The fee connected to impoundment is $100, plus $10 per day storage, and another $150 for disposal. As it turns out, the only payments the scooter companies have had to make to the city of Bloomington are the $10,000 annual licensing fees and the 15 cents a ride. The three companies now operating in Bloomington are Lime, Veo, and Bird." Greetings. In my experience, as well as observations, it does not appear that there is much, if any, enforcement of the Hands-Free Driving state law that went into effect in 2019 in the City of Bloomington. There also doesn't seem to be much accountability to that law as in my experience, the person who rear-ended me told the BPD officer she hit me because she was looking at her phone, but following too close was on the citation and not distracted driving. Why is that? I was told that he didn't want to put more than one reason down. Well, why not distracted driving as that is what she admitted to? Also, there doesn't seem to be any sort of a public safety education campaign in any way... I could imagine that the social media accounts would be a great place for a weekly, bi-weekly, or even monthly Public Safety Announcement (PSA) for some friendly reinforcement, reminders, remedial lessons, etc. about the laws that provide structure around driving a couple ton heavy potentially lethal machine around these safe and civil streets. I think Bloomington motorists need a few reminders on some general laws about operating a motor vehicle, especially the hands-free driving state law. Can someone please speak a bit to this concern of mine? Much obliged for your time.

This orange neon was left in front of our house a week and a half ago. The owner said it would only be a couple of days but we haven’t seen or spoken to him since. We park our 2 vehicles in front of the house and this car is making it difficult.

Drainage or Runoff

3515 E Park LN

Case Date:
5/24/2022

I have a problem on my property with drainage. The drainage of my property runs off naturally into my neighbor's yard. His address is 3514 Morningside Drive. When a storm comes, his back yard pools and remains there for a few days until it is absorbed into the ground. I discussed with one of the neighbors how this might be resolved and volunteered to help pay for pipes that would carry the water that pools in their yard to the ditch along Morningside Drive. The neighbor didn't think that would work. Now they have dug out a deeper hole in their yard and are installing a "Sponge Garden." My understanding is that this will retain water and will not allow my yard to drain. This area has backed up into my basement in the past and flooded it. It seems to me that this will occur more easily with the installment of the "Sponge Garden." I appeal to the city of Bloomington to send engineers to come and see if there is some way that water can be drained into the ditch along Morningside Drive.

Utilities Construction

I spoke with two Martha Street residents who mentioned that they are seeing many people taking a short cut through the culvert that runs east-west between Matlock Heights and Lower Cascades. They indicated that following some utilities work, they were expecting workers to install a No Trespassing or Private Property sign to deter such foot traffic, but that no such sign has been installed. Could you follow up and see what might be done at this site? Thanks!

Bus Services (Bloomington Transit)

3131 N Valleyview DR

Case Date:
5/23/2022

The city bus routinely drives through the Fritz Terrace neighborhood too fast. I don’t have a radar gun but the speed limit is 20 and they are obviously going over. On Saturday 5/21 sometime around 3:00 I believe the bus hit and killed a neighbor’s dog near 3131 Valleyview and continued their route. I did not witness the event but was told by a neighbor the bus stopped for a moment at the same location the dog was hit, near the same time, then continued on. I would like the transit department to identify who the driver was and see what the story is on why they did not stop and try to help or identify the owner of the dog, or if I am mistaken and the driver claims it was not them and perhaps maybe they witnessed the event and could provide more details. Even without the issue of who hit the dog, the bus needs to slow down and not exceed the 20 MPH speed limit. There are lots of kids in this neighborhood, the streets are narrow and the curve at the top of the hill is a blind spot for oncoming traffic. Please address this issue before someone gets hurt or killed.

Sewer Problems (Storm Sewers)

1036 W 6th ST

Case Date:
5/20/2022

All the storm water runoff from the White Oak Cemetery basin, during very hard rains, cannot be handled by the 4-storm drains near the intersection of 7th and Oak Streets. The excess is diverted through the gravel parking of our neighbor at 1025 W 7th, washing the gravel onto the street. The storm water then turns and washes through the alley between 6th & 7th Streets. It then goes through our carport and yard washing our mulch away in places. Oak street was paved in the past and is higher than the storm drain at 7th and Oak so any excess water has do go through the gravel parking instead of down the street. I would be happy to meet someone to look at this problem. Thanks.
