Received this complaint information from Angie Grubb. She said this gentleman called on 6/4/14 to complain about runoff. He just bought the house and there is a swale that takes runoff from Maxwell Terrace but his neighbor put bricks in the swale causing the water to run onto his property. Is this legal?

The property owner, Rega Wood, is concerned about the drainage coming from the north and crossing onto her property. The existing inlets in Rose Ave. cannot handle the amount of water they receive.
Have been having ongoing issues with storm water running down Wilton St. from Arden Dr. and Hillside Dr. Was told Wilton St. was going to be repaved (about two years ago). Street patchwork has began washing out. Storm drains in front of her home were allegedly installed improperly. Has had minimal contact with Phil Peden, Utilities, but not satisfied with City's actions to date.
Dear Mr. Howard, Mr. Peden, Mr. Meyers, and Mr. Rollo, We are the property-owners at 2017 E Marilyn Dr. abutting Mr. Howard’s residential construction project at 1110 S. Covenanter Dr (http://howardshomeimprovement.com). We're writing because we're concerned about the addition of gravel this past week to Mr. Howard’s lot, raising it several feet above our property, creating what looks sure to become a pond of run-off water along the eastern edge of our property and causing likely flooding at the southern edge. A marshy meadow that used to collect water on Mr. Howard’s property has been shifted onto our property. In order to get a sense of the impacts and the city’s review of them, we are hoping to talk with Mr. Howard and a city inspector before further work proceeds. We are also concerned that the property line has not been staked and our property is being used for construction staging, with considerable removal of vegetation and possible spreading of gravel across the property line. Here is a rough calculation of the drainage runoff from Mr. Howard’s property onto ours: The raised area is 30’+60’+10’=100' X 12’ = 1200 sq ft (at the side) and 22’ + 12’ = 34’ X 10’ = 340’ sq ft (at the back) = 1540 sq ft (total). At an average 5” rainfall in May, that would create 4,800 gallons or 640 cu ft of runoff. Annually, rainfall is about 50” so the runoff would be about 48,000 gallons or 6400 cu ft per year. But with climate change we suspect those amounts are going to increase (rainfall for every month this year has exceeded the norm). We arrived at this estimate using the USGS rainfall calculator: https://water.usgs.gov/edu/activity-howmuchrain.html And we used rainfall estimates from: https://www.weather.gov/ind/Precip_scorecard_IND For the raised area of Mr Howard’s property, we used the schematics attached below. We also have attached photographs showing the construction staging on our property, and the effect of the land build-ups on the east side of our property line. Mr Gardner called again this week because he said the pipe under Wylie Farm road is still blocked and nothing has been done since he called in months ago.
She left a voice mail indicating her parents live at this address and have had problems with water damage and drainage for the last couple years. Water comes off neighbor's driveway and across road and down their driveway. She has pictures. She said she and her brother will be in town next week and want to try a resolve this issue. She wanted to know if she could send me pics, have someone look at it and let her know if it might be an issue with the road slope or if it's a private home issue. And if it is a private home issue, who she could call to help her fix it next week. She said she teaches so can't answer the phone but asked me to text her an email address so she could send the photos.
Drainage problems, customer would like a new culvert built. Per Tony Eads, I have assigned this to Phil Pedin in CBU Engineering Dept.
Ms. Aslami left a voice mail on 11/26/13. I returned her call on 11/27/13. She was difficult to understand but I believe she said she has water that comes up from their garage drain when it rains hard and she wants the city to fix it.
This was originally a trouble report left on T&D voice mail on 5/22/14. I visited the site on 5/23 and met with her husband. They have had storm water problems since they moved into the house in 1999. During heavy rain storms, the water flows over the drive and into the garage. They have tried different things and currently have to keep sand bags in front of the garage door but the water still sometimes goes over them.
